A TEACHER found guilty of abusing boys in the 1980s has lost an appeal to overturn his indecent assault convictions.
Jonathan O’Brien, 56, of Fairfield Road, Bosham, was found guilty at Chichester Crown Court in December of 15 counts of indecent assault and five counts of gross indecency.
Three senior judges at the court of appeal in London this week refused the possibility of appeals against the indecent assault convictions.
“Nothing that has been said on behalf of Mr O’Brien persuades us that an adjournment should be granted,” said Lady Justice Sharp.
However, the gross indecency convictions were quashed after problems came to light about the validity of some of the convictions.
Sex offence rules dating back to the 1960s meant he needed to be accused of gross indecency within 12 months of the crime happening, the court of appeal heard.
The prosecution accepted there had been a mistake in charging him for gross indecency.
His lawyers argued he should also be granted an adjournment so his solicitors could consider appealing against the other convictions as well, which was refused by the court.
O’Brien will now be sentenced for the 15 indecent assaults. The sentencing is likely to be held at Chichester Crown Court.
